Question: Can my employer take my company car off me when i go on maternity leave?
I was given the car for personal use ( to get to work and back and weekends) instead of getting a pay rise a few years ago, I have never used the car for work purposes. I read online that they can take the car if they need it for work purposes. They dont need it for work purposes, but i think if they could find a reason they'd need it for 'works purposes' they would do. I just wanted to know where i stand legally , i dont have a contract, but i have worked for the company for 15 years.
Answer:
yes, they take it back because you aren't working
they can take it back and sell it or if it's leased, then they cancel the lease
Having no contract is bad news for you as it means you have absolutely nothing in writing
about the use of the car either
I would say they have every right to withdraw the car. It was initially there for work and they let you use it for leisure. You say they have no need for it, that is your view against theirs. Why do you not have a work contract? No work contract, do they legally have to support you on leave?
Why don't you ask their intentions?
Yes they CAN take it.
youve answered your question already you dont have a contract the agreement was verbal and basically its theyre car if they want it back weather its for work purposes or not they can take it back and theres nothing legally you can do about it except smile sweetly and hand back the keys
If you are on leave (paid or unpaid???) and not using the car for business with the pleasure use (verbal) perk, they can withdraw your use of the car at any time....especially if they are footing the bill to maintain the car with insurance, gas, upkeep, etc...and are not getting a benefit from you to do work for them on leave. You should always put things like this in written form/contract.
Are you planning on going back? When you go back will a car be reissued if you have the car use suspended??? Will you be able to get more $$$ then too?
You need to talk with the boss or Human Resources to iron this out ahead of time. They are the only ones that can answer these questions for you directly.
You said it, it's their car, you have no contract.
Sounds like you've had the car more as a casual perk than a regognised and contracted part of your renumeration.
Do you pay company car tax for it's use?
"I just wanted to know where i stand legally , i dont have a contract"
You've answered your own question.
You don't have a contract, you dont need the car to get to work anymore, so they can take it back.
Of course. The car is a benefit for you while you are working. You don't get it when you aren't working.
